Justices Mansoor, Ayesha Malik make interesting remarks about tweaks

ISLAMABAD (WS News) – Justices Mansoor Ali Shah and Ayesha Malik made interesting remarks regarding the recently approved 26th constitutional amendment during the hearing of a case related to the establishment of a Climate Change Authority. 

During the proceedings, Justice Mansoor Ali Shah engaged in a light-hearted exchange with the additional attorney general. 

Justice Mansoor questioned the absence of the attorney general. The additional attorney general explained that he was busy the previous night due to constitutional amendment matters. 

Justice Mansoor smiled and suggested that all engagements must now be over, urging the attorney general to appear at the next hearing. The court adjourned the case for two weeks. 

While discussing an appeal against a high court decision, Justice Mansoor referred to the constitutional bench. He in a lighter vein asked whether this case would go before the constitutional bench or if they could hear it by themselves. 

He noted that this question seemed to arise daily in the Supreme Court regarding which bench will hear the case. 

Advocate Farogh Naseem commented that political cases had now become constitutional cases, to which Justice Ayesha Malik responded with a smile, saying, “Well then! It’s up to you and your constitutional bench.” 

Justice Mansoor also remarked that they were postponing the hearing for three weeks, suggesting that the situation would become clearer by then, as they too would need some time to understand the amendments. Justice Ayesha added that they could not hear the case concerning Article 199 here.
